These Terms of Service (“Terms”) govern your access to and use of the DockForms Pty Ltd. (“DockForms”, “we”, “our”, “us”) website, platform, and services. By using our services, you agree to these Terms. If you do not agree, you must not use our services.


1. Services Provided

DockForms provides online tools and templates for creating and managing marine safety management documents, including but not limited to JSEA, SWMS, and ITPs.

We may update, modify, or discontinue any part of our services at any time without prior notice.


2. Eligibility

To use our services, you must:

  • Be at least 18 years old.

  • Have the authority to enter into a binding agreement with DockForms (if acting on behalf of an organisation).

  • Use our services in compliance with Australian law and these Terms.


3. Account Registration

  • You may need to create an account to access our services.

  • You are responsible for maintaining the confidentiality of your login details.

  • You are responsible for all activities under your account.

  • You must notify us immediately if you suspect unauthorised use of your account.


4. Fees and Payment

  • Some services require payment. Fees will be clearly stated before purchase.

  • Payments are processed securely through third-party payment providers.

  • All fees are in Australian dollars (AUD) and inclusive of GST unless stated otherwise.

  • Subscriptions (if applicable) will automatically renew unless cancelled in accordance with our cancellation policy.


5. Intellectual Property

  • All content, templates, tools, software, and materials provided by DockForms are owned by DockForms or licensed to us.

  • You are granted a limited, non-exclusive, non-transferable licence to use our services for your business purposes.

  • You must not reproduce, modify, distribute, or create derivative works from our materials without our written consent.


6. User Content

  • You retain ownership of any content or data you upload to DockForms.

  • By uploading content, you grant DockForms a licence to use, store, and process that content to provide our services.

  • You must not upload unlawful, harmful, or infringing content.


7. Acceptable Use

You agree not to:

  • Misuse our services or attempt to gain unauthorised access.

  • Use our services for illegal purposes.

  • Interfere with or disrupt the security or performance of our services.


8. Disclaimers

  • DockForms provides general templates and tools for marine safety management documentation.

  • We do not guarantee compliance with all industry-specific or legal requirements. It is your responsibility to review and adapt documents for your specific use case.

  • Our services are provided on an “as is” and “as available” basis.


9. Limitation of Liability

To the maximum extent permitted by law:

  • DockForms is not liable for any indirect, incidental, or consequential damages.

  • Our total liability for any claim arising out of or in connection with our services is limited to the fees paid by you for the services in the 3 months preceding the claim.


10. Termination

We may suspend or terminate your access if you breach these Terms or misuse our services. You may stop using our services at any time.


11. Governing Law

These Terms are governed by the laws of Western Australia, and you submit to the exclusive jurisdiction of the courts of Western Australia.


12. Changes to Terms

We may update these Terms from time to time. Updated versions will be posted on our website with the effective date.
